…begs to withdraw Police IG from suit
The social media popular lawyer, Inibehe Effiong has chickened out in court by withdrawing a suit against the inspector general of police as a 5th respondent in the case between one Mr. David Udo and Barr. Onofiok Luke.
Effiong is a lead counsel to David (applicant) who is claiming having been manhandled by a security detail attached to Luke (1st respondent) and seeking monetary compensation worth N500m
In a court sitting on December 6, 2017 as presided by Justice Fatun Riman, Effiong pleaded the judge to strike out the 5th respondent as he was no longer interested in joining the 5th respondent.
Arguing that a plea of such changes the nature of the case, as it is an amendment of the originating process, counsel to the 1st respondent, Barr. Ekemini Udim inquired from the Judge what will happen if an affidavit that was taken before the commissioner of oath is not withdraw before him.
Responding, Effiong said joining the respondents was for them to be bound, adding that they would not be bound if not joined.
In his verdict, Justice Riman noted that a counsel has the right to sue any party or withdraw a case against same as he wishes. He further granted the plea and withdrew the 5th respondent.
